Terms of Service

These Terms govern your use of photonect.net, ai.photonect.net, and any related services (the "Services") operated by Al-Bawaba for Digital Marketing LTD, Iraq ("Photonect", "we"). By using the Services you agree to these Terms.

1. The Services

Photonect provides creative and AI-assisted tooling, including AI Studio — a workspace for generating brand kits, logos, social content, and related creative assets. Some features rely on third-party AI providers and may produce results that are imperfect, inconsistent, or unsuitable. You are responsible for reviewing outputs before public use.

2. Your account

You must be at least 18 years old, or the age of majority in your jurisdiction. Keep your sign-in credentials secure. You are responsible for everything done under your account. One account per person.

3. Acceptable use

You agree not to:

  • Use the Services to generate content that is unlawful, defamatory, deceptive, infringing on intellectual property, or sexually exploitative.
  • Reverse engineer, scrape, or resell access to the Services.
  • Attempt to access another user's account or data.
  • Use the Services to send unsolicited communications (spam).
  • Bypass usage limits or impersonate Photonect.

We may suspend or terminate accounts that violate these rules.

4. Your content

You retain all rights to the inputs you provide and to the outputs you generate. You grant Photonect a non-exclusive, worldwide license to host and process your content solely to operate the Services for you. We do not use your content to train our own AI models, and we do not sell it.

5. AI outputs

AI-generated outputs may not be unique to you. The same or similar outputs may be generated for other users from different inputs. You are responsible for verifying outputs do not infringe third-party rights before public or commercial use.

6. Fees

Some features may require a paid subscription or pay-per-use credits. Pricing and billing terms are disclosed at the point of purchase. Paid features are subject to additional terms presented at sign-up.

7. Termination

You may close your account at any time by emailing us. We may suspend or terminate accounts for breach of these Terms, fraud, or legal obligation. On termination, we retain data only as required by law, and you may request export of your content beforehand.

8. Disclaimer of warranties

The Services are provided "as is", without warranty of any kind, express or implied. Photonect does not guarantee uninterrupted, secure, or error-free operation, nor that outputs will meet your requirements.

9. Limitation of liability

To the maximum extent permitted by law, Photonect is not liable for indirect, incidental, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Services. Our aggregate liability is limited to the amount you paid us in the 12 months preceding the claim, or USD 100, whichever is greater.

10. Governing law

These Terms are governed by the laws of the Republic of Iraq. Disputes shall be resolved in the competent courts of Baghdad, Iraq, unless otherwise required by mandatory consumer protection laws of your country.

11. Changes

We may update these Terms as the Services evolve. We will post the updated version with a new "Last updated" date. Continued use after the update constitutes acceptance.
